Virginia Military Divorce Attorney

Experienced Military Divorce Lawyer

Serving Clients Throughout the Commonwealth of Virginia

Governed by federal and state law, military divorces present different complexities than civilian divorces. You need an attorney who is experienced with military regulations and can help you protect your rights. At McDevitt Family Law in Fairfax County, Virginia, I have helped military service members and their spouses for more than a decade.

I am Lisa Lane McDevitt. As a dedicated, results-driven attorney, I have restricted my practice to family law to better serve you. I take personal pride in garnering the unique and extensive knowledge of military divorce that will benefit your case.

I handle cases involving:

  • Domicile and residency requirements for filing and service of process
  • Division of military retirement in divorce under the Uniformed Services Former Spouses Protection Act (USFSPA)

Unique Challenges

Child custody can be especially challenging in military divorce, as military parents may have to relocate frequently with transfers or deployments.

Division of property also can be complicated. Military pensions, for instance, are subject to different rules than private retirement accounts. Under the Uniformed Services Former Spouses Protection Act, the state courts will determine how a servicemember's disposable retired pay is divided.

You may face delays in your divorce under the Servicemember's Civil Relief Act, which protects service members from lawsuits, including divorce, during active duty and 60 days following.

Whatever obstacles there may be in your case, I am prepared to help you resolve issues as quickly and easily as possible.

Communication with clients is a priority for me, and you can rely on me for regular updates about your case. Serving as a resource and a guide, I am accessible whenever you have questions or concerns. I return all phone calls within 24 hours — even when I'm on vacation.
