A Time-Saving Approach to Divorce
Serving Clients Throughout the Commonwealth of Virginia
While divorce is an ending, it also represents a new beginning. When you are ready to move on to the next stage in your life, you do not want to be held up by legal delays and conflicts with your spouse. You need deft representation to usher you through the process swiftly and smoothly. At the law office of McDevitt Family Law in Fairfax County, Virginia, I have helped clients through divorce for more than a decade, and I can help you avoid hassles.
As an experienced attorney, I have a record of successful outcomes for clients seeking a divorce. Because I have restricted my practice to family law, I have amassed comprehensive knowledge about divorce and related issues. Combining my strategic insight with strong problem-solving and communication skills, I can help you resolve disputes out-of-court or in the alternative through mediation or trial.
I represent clients in all types of family law cases, including:
- Military divorce
- Mediation
- Child custody and child visitation
- Child support and modification
- Property division
- Military and non-military retirement pension
- Relocation
- Spousal support (also known as "alimony")
- Incarcerated spouse

How Long Is This Going to Take?
A common concern in divorce cases is how long the process will take. I have developed a flow chart illustrating different options for divorce and how long each step within that option would take. In addition to laying out your choices, I will clearly explain the law in Virginia, your rights and risks and the local procedure in your county.
Avoiding litigation can save you months or even years. While I can help you complete an uncontested divorce in a matter of weeks, you may spend several years trying to resolve a divorce in court.
One of the key elements of a quick and easy divorce is signing a separation agreement. In Virginia, couples must be separated for a minimum of one year to obtain a divorce unless they sign a separation agreement. If you sign a separation agreement and you have no minor children, you only need to be separated for six months before you can file for a divorce. If you have minor children, you must be separated for one year before you can file for divorce. It is critical that you at least attempt to enter into a separation agreement while you are waiting to file for divorce. Please see "Separation Agreements" to learn more about this very important stage of your divorce.
